White House Clarifies Scope of H-1B Proclamation

As FGI continues to monitor the repercussions of the Presidential Proclamation issued on September 19, we are providing important clarification issued today by White House Press Secretary Karoline Leavitt via her official post on X.
Key Clarifications from the White House
- One-Time Fee, Not Annual: The $100,000 fee outlined in the proclamation applies as a one-time charge at the time of filing. It is not an annual recurring fee.
- New Filings Only: The fee applies only to new H-1B petitions filed on or after September 21, 2025.
- Existing H-1B Holders Unaffected: Current H-1B visa holders, including those requesting extensions of stay or amendments, are not subject to the new fee. Petitions filed and receipted before the effective date also remain unaffected.
- Travel Not Impacted: H-1B visa holders may continue to leave and re-enter the United States to the same extent as they normally would. The proclamation does not alter existing travel rights or reentry ability.
