Department of State releases Visa Bulletin for May 2025: Final Action Dates for most categories remain the same
On April 11, 2025, the U.S. Department of State (DOS) issued its monthly Visa Bulletin for May 2025. The USCIS confirms it will be accepting adjustment of status applications based on the Final Action Dates chart:
- The Final Action Date for EB-3 India will advance by two weeks to April 15, 2013.
- The Final Action Date for EB-5 India will retrogress by six months to May 1, 2019.
There are no other movements in the employment based (EB) categories for May 2025.

Department of Labor updates PERM and PWD processing times for April 2025
The Department of Labor (DOL) has updated its processing times for prevailing wage determinations (PWD) and PERM applications for April 2025.
- As of April 1, 2025:
- DOL has been processing H-1B prevailing wage determinations (PWDs) filed in November 2024 (OEWS Receipt Date) or earlier, and October 2024 (non-OEWS Receipt Date) or earlier.
- DOL has been processing PWDs for PERMs filed November 2024 (OEWS Receipt Date) or earlier, and October 2024 (non-OEWS Receipt Date) or earlier.
- DOL has been processing H-1B redeterminations filed in December 2024 or earlier.
- DOL has been processing PERM redeterminations filed in December 2024 or earlier.
- DOL has been processing H-1B Center Director reviews requested in August 2024 or earlier.
- DOL has been processing PERM Center Director reviews requested in August 2024 or earlier.

AILA and AIC submit comments on USCIS’s interim final rule on the Alien Registration Form and Evidence of Registration
- The American Immigration Lawyers Association (AILA) and the American Immigration Council (AIC) submitted comments on the USCIS Interim Final Rule (DHS Docket No. USCIS-2025-0004) on the new alien registration requirement. The comments argue that the IFR violates the Administrative Procedure Act (APA), the Paperwork Reduction Act (PRA), and the Fifth Amendment.
- Comments on the IFT must be received by May 12, 2025. Please submit comments through the Federal eRulemaking Portal at https://www.regulations.gov.
- AILA and partner organizations also filed a lawsuit last week challenging the rule; however, the U.S. District Court for the District of Columbia denied the motion to delay its effective date.
