THAILAND – Fraud-Prevention Measure to Increase Work Permit Documentation Requirements

As of Monday, January 19th, Thailand’ new fraud-prevention measure has been in effect. This measure requires that all work permit applicants obtain certification per each document by the appropriate agency. For the following documents, non-certified versions will no longer be accepted:

  1. A copy of the employer’s financial statement in Thai. Must have a balance sheet and a profit-and-loss statement for the previous year, audited and signed by a CPA, and certified by either the Revenue Department or the Ministry of Commerce.
  2. A copy of the corporate income tax return and receipt for the previous year; this must be certified by the Revenue Department.
  3. A copy of the company’s monthly salary withholding tax and receipt for the most recent month for all Thai and foreign employees. This must be certified by the Revenue Department.
  4. A copy of the monthly Value Added Tax (VAT) return and receipt for the most recent month of all the Thai and foreign employees. This must be certified by the Revenue Department.
  5. A copy of the monthly Social Security contributions and receipt for the most recent month for all Thai and foreign employees, which must be certified by the Social Security Office.
  6. A copy of the audited financial statement for the previous year, acknowledged by the Department of Business Development. This statement must receive certification from the Ministry of Commerce.
  7. A copy of the employee’s personal income tax return and receipt for the most recent year, which must be certified by the Revenue Department.

Although processing times are not expected to change, obtaining the official certifications adds time and expense to the document preparation process.
