TN Visa Challenges
Correct job classification
Employers must place the proposed position in the correct TN job classification.
Meeting educational requirementsÂ
Employers must ensure that the candidate meets the educational or licensing requirements (i.e., that their degree matches the field in which they work).
Meeting customs & border requirements
Candidates and employers must meet all the U.S. Customs and Border Protection (CBP) requirements, given that these change with some frequency, if applying at a consulate or a port of entry.
Applying for extensions
Candidates and employers need to demonstrate to the CBP that the position is temporary when applying for successive extensions. Candidates must also demonstrate that they do not possess immigrant intent at the time they apply for admission to the U.S. in TN status.
