PERU – Forthcoming Immigration Law Amended

The new Aliens Act (Legislative Decree No. 1236) that will aim to revamp work visas and pertinent procedures once it is in effect sometime in 2016, has been recently amended by the government. Talent Short-Term (T16 visas) and Appointed Workers (T18 visas) categories will be affected by these changes. The Aliens Act will published approximately on March 30, 2016 and the law is expected to come into force 90 days later.
Particulars of the amendment include:
- Talent Short-Term (T16 visas) – T16 visa holders may apply for Provisional Residency if the period of stay exceeds 90 days. T16 visas hold a validity period of up to 90 days which allows multiple entries but is not renewable. T16 visas are for foreign nationals in science and technology fields endorsed by the Peruvian government.
- Appointed Workers (T18 visas) – T18 visas may be granted for up to 90 days either consecutively or accumulatively during a one-year period and can be extended for up to one year. T18 visa holders are employees of foreign companies being sent to Peru to execute specific duties under a service agreement and are able to carry out certain transactions such as signing contracts but are not allowed to perform subordinated work activities.
