GERMANY – Stricter Enforcement of Immigration Policies

The German Federal Employment Agency is now evaluating work permit extension applications with greater scrutiny. If an employer is unable to prove that they have paid the full salary that they indicated at the time of the work permit’s application for the foreign employee’s entire assignment, it is likely that the application for the work permit extension will be denied. Please note that even minor discrepancies in the monthly salary figures will be noted. Additionally, recent weeks have shown an increase in the number of on-site immigration audits. During these on-site audits, the employer is required to provide evidence of work and residence permits for all foreign employees. Employers should be aware of these recent changes to German immigration enforcement and prepare accordingly.
