France – New Online Filing System for Secondment Declarations

As of October 1, 2016, employers who are transferring their employees to work in France on detachment status are now required to file the Secondment declaration (prior detachment declaration) directly through an online system. The employer is required to provide detailed information regarding the sending company “the employer”, including personal information for company’s Director.

Employers failing to file this mandatory declaration, prior to the start of an assignment can be fined up to 2,000 Euros for each assignee on detachment (4,000 Euros should this reoccur), with a maximum fine fixed at 500,000 Euros per employer. The host company or project owner are also liable if they fail to verify that the declaration has been filed.
