CANADA – CIC Introduces New Employer Portal

Citizenship and Immigration Canada (CIC) now requires that employers submit Offers of Employment for Labour Market Impact Assessment (LMIA) for exempt foreign workers (Intracompany transferees, NAFTA professionals and International Experience Canada participants) through the Employer Portal under their newly implemented electronic system that took effect on October 26, 2015.
CIC is still officially accepting paper IMM-5802 forms from foreign workers if their employers submitted the compliance fee and signed the form prior to October 26, 2015. However, they will only accept submission of paper-based forms until November 21, 2015. Appointed third-party representatives are allowed access to the portal to file documentation on behalf of employers.
CIC seeks to reinforce employer accountability under the International Mobility Program by way of this new process. Affected employers should enroll in the Employer Portal as soon as possible if they seek to submit Offers of Employment for Labour Market Impact Assessment applications.
