Austria – Appointment of Information Agent and Document Storage for Now Required for Some Employers

According to a new law that goes into effect on January 1, 2017, employers based in the European Union/Economic Area or Switzerland that send employees on assignment to Austria, must now appoint a document maintenance and information agent.

Documents of all the employees sent to Austria that are assigned to a specific project must be stored and be easily accessible to a migration officer, if an audit were to occur. The documents may be stored in the Austrian workplace, the agent’s workplace, or the offices of an Austrian affiliate of the EU/EEA/Swiss employer.

The appointed agent and document storage location must be disclosed before every project. Non- European Union/Economic Area and Switzerland employers must follow the document storage rules, however, do not need to appoint an agent to maintain the documents.
