Australia – New Guidelines for Labor Market Testing for Intra Company Transfers

As of April 5, 2018, new guidelines have been released in regards to Labor Market Testing for the Temporary Skill Shortage (TSS) visa.
For nominated positions of intra-company transfers, alternative evidence can now be used in place of the labor market test, which demonstrates that “a suitably qualified and experience Australian worker is not available to fill the nominated position”.
The exemption of advertising is also applicable in a distinguished talent scenario or a new nomination has been lodged due to the change of business structure.
